Your employee’s unlawful behaviour
= Your vicarious liability risk
Employers can be held legally responsible for acts of discrimination and harassment that occur in the workplace or in connection with a person’s employment.
Demonstrating that you have taken reasonable steps to prevent unlawful behaviour is at the top of the HR risk control measures list.
If you can’t demonstrate the reasonable steps you have taken, you can be held jointly liable.
Need help understanding what risk mitigating measures you can take?
